NEW DELHI — In a big development in the case of the Babri Masjid on Friday, the proofs of Muslims having the keys of the mosque in 1949 were presented in the Supreme Court. Judicial testimonies of 13 Muslims who offered Namaz in the mosque between 1934-1949 were also presented in the apex court. Several government documents proving Muslims were in possession of the mosque were also presented in the court.
Today was 23rd day of the hearing in the Babri Masjid title suit. In the morning session, counsel for All India Muslim Personal Law Board Adv. Zafaryab Jilani argued the case while in the post-lunch session, counsel for Jamiat Ulama-I-Hind, Dr. Rajiv Dhawan presented the case.
Adv. Jilani presented proofs of Muslims offering Namaz in the mosque between 1934-1949. The documents he presented in the top court included verdict of the Faizabad court, court order for beautification of the Babri Masjid, receipt of money, demand for pending bill for beautification of the mosque, PWD document showing satisfaction on beautification of the mosque, receipt of salary to Imam of Babri Masjid Maulvi Abdul Ghaffar, Imam’s petition for release of pending monthly salary of Rs 5 before Faizabad Waqf Commissioner, Waqf Inspector Mohammad Ibrahim’s report that Muslims were disturbed on Dec 10 and 12 in 1949 when they came to offer Namaz, Waqf Commissioner’s Report that Muslims had keys of the mosque on December 23, 1949 and they offered Juma prayers.
Adv. Jilani also read out the judicial testimonies of 13 witnesses who offered Namaz in Babri Masjid between 1934-1949.
For past three weeks, the Supreme Court has been hearing the decades-old title suit of Babri Masjid on daily basis following the failure of the court-appointed mediation panel to resolve the dispute.
Some Hindutva groups have been claiming that the 16th century Babri Masjid was erected on the debris of a temple and that the place was birthplace of Rama. Muslims have always denied the charge.
While the title suit was pending in the court, a huge mob of Hindutva supporters razed the mosque on December 6, 1992 in the presence of then top leaders of BJP, including LK Advani, MM Joshi and Umar Bharti. All of them are facing conspiracy charges in the Babri Masjid demolition case.
