AZAMGARH/ NEW DELHI: Moving into election gear, Prime Minister Narendra Modi on Saturday revived the issue of Triple Talaq while addressing a public gathering in Azamgarh of Uttar Pradesh and tried to corner the Congress party on the issue.
“For the last two days I am hearing, that a naamdar leader (Rahul Gandhi) recently said that Congress is a party of Muslims (his reference to Gandhi’s meeting with some Muslim intellectuals in Delhi earlier this week). I’m not surprised. Even Former Prime Minister Manmohan Singh once said that Muslims have the first right over nation’s natural resources. But I want to ask the naamdar of Congress, please tell that is the party only for Muslim men? Because they don’t stand with Muslim women on issues of triple talaq and Nikah halala,” said PM Modi after laying the foundation stone of the Purvanchal Expressway in Azamgarh.
The Congress did not take time and asked PM Modi to revisit the objections raised about the provisions or lack of them in the Triple Talaq bill last year.

Shortcomings of Triple Talaq Bill
The party had supported ban on instant Triple Talaq but demanded changes in the bill to make it comprehensive and acceptable:
— There is no doubt about the fact that Congress will help the government to bolster the right of Muslim women. But the bill needs to be watertight when it comes to the financial security of women.
— Section 5 of the proposed Triple Talaq Bill has discussed subsistence allowance. The details of this allowance are not present in the Bill. Will divorced woman’s maintenance be continued, is not clear.
— When the husband is jailed after Talaq, will the wife have rights on husband’s property or will she be abandoned? The Bill should give clarification of these things.
— Triple Talaq Bill is a significant Bill. Congress has maintained that any action to protect a woman’s rights is always encouraged. However, there are some issues the bill needs to clarify like whether the burden of proof of Triple Talaq lies on the wife.
— Unlike Section 498(a) where the accused had the burden of proof regarding dowry, the Triple Talaq Bill does not clarify on whom the burden of proof lies.
